Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Acumen Renovations (“Acumen,” “we,” “us,” or “our”) governing your use of acumenrenovations.com, including its instant-quote calculators, contact forms, scheduling tools, and newsletter (together, the “Site”).

By checking the “I agree” box, submitting a quote request or contact form, subscribing to our newsletter, or otherwise using the Site, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site.

Acumen Renovations is a residential general contractor owned and operated by Joshua Harden, serving the Kansas City metro area.

The Site lets you describe a home-improvement project (deck, concrete, fence, painting, siding, or windows and doors), receive an instant estimate, request a formal quote, and propose times for a site visit.

An instant estimate is not an offer, a quote, or a contract. It is a preliminary, automated calculation based solely on the information you enter and our current standard pricing. Actual pricing depends on a site visit, verified measurements, site conditions, material availability, permits, and other factors we cannot assess online. Instant estimates are provided for planning purposes only and may change without notice.

A formal quote or proposal that we later send you (by email, as a PDF) is a separate document with its own terms. Any construction work we perform for you is governed exclusively by the written proposal/contract you and Acumen sign — including its provisions on acceptance, cancellation, rescission, payment, permits, warranty, mechanic’s lien notice, and dispute resolution — and not by these Terms. If there is a conflict between these Terms and a signed proposal or contract, the signed document controls for that project.

Nothing on the Site obligates Acumen to perform work, and nothing obligates you to hire Acumen.

By using the Site you represent that:

• you are at least 18 years old and able to enter into a binding agreement;
• the information you provide (name, contact details, property address, project details, measurements, availability) is accurate and current, and you will update it if it changes;
• you own the property you describe, or you are authorized by the owner to request estimates and work for it; and
• you are using the Site for your own genuine interest in a home-improvement project, not to scrape pricing, benchmark competitors, or otherwise use our tools for a purpose unrelated to hiring us.

You are responsible for the accuracy of any measurements, dimensions, or property outlines you enter or draw. Estimates based on inaccurate inputs will be inaccurate.

Our Privacy Policy is the full statement of our data practices. In summary, when you use the Site we collect:

• Contact information you enter — first and last name, email address, phone number, and street address / city / state / ZIP code.
• Project information you enter — the service you want, dimensions and measurements, materials and options, features of your home relevant to the job (for example, number of stories, year-built range, or HOA status where a calculator asks), your project timeline and budget range, and any message you write to us.
• Property location — when you use the map-based measurement tools or address lookup, the geographic coordinates of your property and any outline you draw on the map.
• Scheduling preferences — the dates and time blocks you propose for a site visit.
• Technical and usage information — information your browser sends when it requests pages, and, only if you accept our cookie banner, analytics data about how the Site is used. We also use browser storage to remember your progress through a quote so you don’t lose your selections.

We use this information to:

1. calculate and deliver the estimates you request;
2. prepare and send formal quotes and related documents;
3. contact you about your request — by email, and by phone at the number you provide — to ask follow-up questions, schedule a site visit, or discuss your project;
4. schedule and confirm appointments;
5. send newsletter emails, only if you separately subscribe and confirm your address;
6. keep our records of estimates, quotes, and communications for business, legal, and warranty purposes;
7. operate, secure, and improve the Site, including preventing abuse and rate-limiting automated traffic.

We do not sell your personal information, and we do not share it with third parties for their own marketing.

Providing your email address and submitting a request on the Site is your consent for us to email you about that request. These are service (transactional) messages tied to something you did on the Site, and include:

• an acknowledgement when your quote request is received, summarizing your project details and estimated total;
• your formal quote, including a private link to view your quote PDF;
• notice when a quote is marked accepted or declined;
• appointment confirmations and scheduling details;
• confirmation and welcome messages if you subscribe to our newsletter.

Because these messages relate directly to your request, you cannot unsubscribe from them while your request is active; if you no longer want to hear from us about a request, contact us and ask us to close it.

Newsletter and marketing emails are separate. We send them only if you subscribe and confirm your address (double opt-in), and every such email includes an unsubscribe link that takes effect immediately.

Phone. By providing a phone number you agree that we may call you about your request. We will not send you marketing text messages unless you separately agree to receive them.

Our service emails are sent through a third-party email delivery provider on our behalf. Our automated emails are sent from an unmonitored address; replies may not be read — use the contact details in Section 2 instead.

Times you propose through the Site are requests, not confirmed appointments. An appointment is confirmed only when we notify you that it has been scheduled. We may need to reschedule, and you may cancel or reschedule by contacting us.

When we send you a formal quote, the email contains a private link that lets anyone holding it view your quote PDF, which includes your name and contact details. Keep the link private and do not forward it to people who should not see that information. Quote links expire 30 days after the quote is created; contact us if you need a fresh copy after that.

You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms;
• enter false contact information or request estimates for property you are not authorized to act for;
• submit requests on behalf of another person without their permission;
• use bots, scripts, scrapers, or automated tools to access the Site, harvest pricing, or generate estimates in bulk;
• attempt to bypass rate limits, access controls, or any security feature, or to access another person’s quote, account, or data;
• interfere with the Site’s operation, introduce malicious code, or place unreasonable load on our systems;
• copy, reproduce, reverse-engineer, or create derivative works from the Site or its pricing logic;
• remove or alter any copyright, trademark, or proprietary notice; or
• use the Site to send spam or unsolicited communications.

We may block, throttle, or terminate access for anyone we reasonably believe has violated this section, without notice or liability.

The Site and everything on it — text, images, logos, page designs, calculators, pricing methods, PDF layouts, and software — are owned by Acumen Renovations or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for its intended purpose. No other rights are granted.

You keep ownership of the information and content you submit. You grant us a non-exclusive, royalty-free license to use it as needed to operate the Site, prepare your estimates and quotes, communicate with you, and keep our business records.

If you send us feedback or suggestions about the Site, you agree we may use them without restriction or compensation.

The Site relies on third-party services that may collect information directly from your browser, subject to their own terms and privacy policies. These include map, satellite-imagery, and address-lookup services used by our measurement tools (your typed address is sent to the provider to return suggestions and imagery), an embedded map of our office location, and — if you accept our cookie banner — a web analytics service. We also use third-party providers for hosting, database, file storage, and email delivery; they process your information only on our behalf. We are not responsible for third-party services, and links to other websites do not imply endorsement.

THE SITE, THE INSTANT ESTIMATES, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES WILL MATCH FINAL PRICING, THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

This disclaimer applies to the Site and its online tools only. Warranties for construction work we perform are set out in your signed proposal/contract and are not affected by this section.

TO THE FULLEST EXTENT PERMITTED BY LAW, ACUMEN RENOVATIONS AND ITS OWNER, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON AN INSTANT ESTIMATE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the greatest extent the law allows. This section does not limit liability under a signed construction contract, which is governed by that contract.

You agree to defend, indemnify, and hold harmless Acumen Renovations and its owner, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, information you submit that is false or that you were not authorized to submit, or your violation of any law or third-party right.

We may change, suspend, or discontinue any part of the Site at any time without notice. We may refuse service, block access, or delete submitted data at our discretion, including for violations of these Terms. Sections that by their nature should survive (including Sections 10, 12, 13, 14, and 17) survive termination.

You agree that we may communicate with you electronically (by email and through the Site), that electronic notices satisfy any legal requirement that a communication be in writing, and that a formal quote or proposal we send you electronically may be accepted by electronic signature or other electronic means with the same effect as a handwritten signature, to the extent permitted by the federal E-SIGN Act and the Kansas Uniform Electronic Transactions Act. This section does not waive any right of rescission or other consumer protection you have under Kansas or federal law for construction contracts.

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law rules. If a dispute arises out of these Terms or your use of the Site, you and Acumen agree to first try to resolve it informally by contacting each other, and, if that fails, to submit it to non-binding mediation before either party pursues litigation. Any legal proceeding will be brought exclusively in the state or federal courts located in Wyandotte County, Kansas, and you consent to their jurisdiction and venue.

Nothing in this section applies to disputes under a signed proposal or contract, which are governed by that document.

We may update these Terms from time to time. The effective date at the top shows when the current version took effect. Material changes will be posted on this page; your continued use of the Site after a change means you accept the updated Terms. If you don’t agree, stop using the Site.

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of our business. These Terms, together with the Privacy Policy, are the entire agreement between you and us about your use of the Site. Nothing in these Terms creates an agency, partnership, or employment relationship. Headings are for convenience only.
